Intersection between the ADA/FMLA/Workers’ Comp
The intersection of the ADA, the FMLA, and state workers’ compensation laws often causes headaches for experienced human resources professionals. For that reason, it is often referred to as the “Bermuda Triangle of Employment Law.”
When an employee seeks leave from work an employer must decide if, and how the ADA, FMLA, and or Workers’ Compensation laws will apply and or overlap. An employer must also consider the interplay between the federal ADA and FMLA laws as well as state-equivalent statutes. As states continue to promulgate new laws regarding family and/or medical leave, and as the Equal Employment Opportunity Commission continues to focus on employer leave policies, it is critical for employers to make sure they are compliant with each of these laws. This webinar will consist of a discussion of the purposes and main provisions of each law, the particular legal risks associated with each law, and ways for employers to navigate their way through common difficulties associated with these various leave-related laws.
