Service Animals in Your Business

As the kick off to the holiday season brings more customers into restaurants we have received a number of requests for specific guidelines regarding Service Animals. A good place to start is to review the Department of Justice (DOJ) Civil Rights Division guidance document, "Commonly Asked Questions about Service Animals in Places of Business". This 1996 document is still relevant; however a new redefinition of Service Animals did go into effect in March 2011. Under the new definition, a service animal is not a comfort or support animal. It may only be a dog, or in some instances a miniature pony.


The California Retail Food Code (CRFC 114259.5) clearly states that animals (as pets) shall not be allowed in a Food Facility. If the Service Animal is not under the control of the handler, the food facility has the right to request that the animal be placed outside the food areas. Behavior such as barking and licking packages are some examples of lack of control. Conversely, if another patron is deathly afraid or allergic to dogs, under the DOJ, this is not enough to have the Service Animal removed.
