Wage Theft Prevention Ordinance Introduced
posted on Monday, Jun 6, 2011
Supervisors Mar and Campos have introduced the "Wage Theft Prevention Ordinance" that would add additional penalties for violation of the minimum wage laws and would grant the office of Labor Standards additional enforcement powers for minimum wage compliance.
Specifically the measure would:
Require the City to make every effort to resolve minimum wage complaints in one year. Reduce the daily per person violation from $500 per day to $50 per day. Require employers who are being investigated for a complaint to inform the employees of the investigation and how they can contact the agency. Increase the fine from $500 to $1000 for retaliation for exercising rights under the minimum wage ordinance and adds a $500 penalty for failure to post notice of the minimum wage rate.
The measure could help level the playing field against those restaurants that are not properly complying with the minimum wage ordinances and under cutting those businesses that are complying with the law.
